Prevailing debate obscures the fact that we already have a form of gun control in the United States. As legal scholar Ben Levin explains, the problem is that it’s a form of gun control that is mostly about locking up poor black men in huge numbers. See also the public defenders who filed an amicus brief in the 2022 SCOTUS New York gun control case arguing that gun control laws harm their clients. “We share the collective concern about gun violence. But feeding the prison pipeline with a steady stream of Black and Brown people, as New York’s law did, is not the answer.”
