Federal judge says 11 parents separated from children can return to US -

wtfisgoingonews:

A federal judge on Wednesday ordered the U.S. to allow 11 parents who were deported without their children entry back into the U.S.

San Diego District Court Judge Dana Sabraw ruled that the Trump administration unlawfully prevented the parents from pursuing asylum cases, according to The Associated Press.

In some cases, Sabraw found that agents coerced parents to drop their claims and accept deportation by having them sign documents they didn’t understand or telling them that asylum laws had changed.

Sabraw declined to allow seven other parents in the original request to return.

The 11 parents were separated from their children during the Trump administration’s “zero tolerance” immigration policy.

Reminder that children are STILL being separated from their parents on the border, the administration is STILL looking to end the Flores Settlement, and yesterday the The Health and Human Services inspector general released a 48-page report on the intense psychological toll & the effects of it experienced by the children who were separated from their families.

Jones loses appeal in Texas lawsuit with Sandy Hook father -

news-queue:

As first reported by Right Wing Watch, the Texas Court of Appeals tossed an appeal Jones had filed in a defamation case there and ordered him to pay court costs.

Infowars and Jones are defendants in a lawsuit filed by Neil Heslin, the father of 6-year-old Jesse Lewis, who said the website aired claims that Heslin said were meant to insinuate he lied about holding his murdered son’s body, resulting in harassment and emotional damage by those who believe Sandy Hook was a “false flag” conspiracy.

According to Right Wing Watch, Heslin had filed a motion for expedited discovery and a motion for sanctions against Jones, who had filed a motion to have Heslin’s lawsuit dismissed under the Texas Citizens Participation Act, a 2011 Texas law meant to aid individuals facing a frivolous lawsuits.

However, the judge hearing the case agreed with Heslin that Infowars’ efforts to delete content relevant to his case had hampered his ability to respond to Infowars’ motion to dismiss, Right Wing Watch reported.

A judge extended the hearing date on Infowars’ motion to dismiss and ordered Infowars to respond to discovery requests, according to the website, but when the deadline for discovery approached, Infowars made clear it did not intend to cooperate. Heslin then filed a motion for contempt of court.

Lawyers for Infowars argued that because defendants had appeared in court regarding their motion to dismiss, they were not required to comply with the discovery process, according to Right Wing Watch. But The Texas Court of Appeals disagreed with Infowars’ interpretation of Texas law and tossed the appeal.

“We agree with Heslin that the district court has not yet ruled on Appellants’ motion to dismiss, nor has the motion been overruled by operation of law. Accordingly, we dismiss the appeal for lack of jurisdiction,” Justice Gisela Triana wrote in an Aug. 30 ruling.

The court also ruled that Jones “shall pay all costs” relating to the appeal.

Heslin’s lawyer in the case, Mark Bankston, said the next steps in the case won’t be clear until parties meet with the court.

“Mr. Heslin is very pleased with the decision of the Court of Appeals dismissing InfoWars’ appeal and ordering Mr. Jones to pay costs. After InfoWars wasted everyone’s time on a frivolous appeal, we can now return to the trial court where we intend to hold Mr. Jones fully accountable for his disgusting defamation of Mr. Heslin,” Bankston told Right Wing Watch.

In addition to his legal troubles in Texas, Jones is facing a defamation claim filed by other Sandy Hook families in Connecticut court.

64-year-old Sikh man stabbed to death in US state of California -

news-queue:

Parmjit Singh was attacked in Gretchen Talley Park in Tracy around 9 pm on Sunday. He died from his injuries, ABC News reported.

Detectives say a passerby spotted the man bleeding on the ground and immediately called 911. Police have launched a homicide investigation.

Police don’t have any clear suspects just yet. On Monday, they asked for the community’s help in identifying a man captured on video hopping a fence and running away from the park around the time when the incident took place, according to the report.

“We just need to figure out who that is, why they were in the area, what they may have seen and potentially any of their involvement in the incident,” said Tracy Police Spokesperson Lt Trevin Freitas.

Singh was wearing a traditional Sikh turban as he always would for his walks twice a day. Some residents are worried Singh may have been attacked because he was Sikh.

Police said they cannot say if it was a hate crime.

“We can’t say what it was right now. We’re keeping all possibilities open. We have no information that would lead us to the motive of this crime. It is something that we can’t disprove at this time and we’re actively investigating all possibilities,” Freitas said.

Harnek Singh Kang, the victim’s son-in-law, said Singh immigrated to Tracy from India three years ago and was an active member of the Sikh community.

“We feel very safe in the country, so whatever happened, this is unacceptable,” he said.

Singh had two kids and three grandkids.

The attack has left the neighbourhood shaken. Neighbours said they were all deeply saddened by what happened.

“Absolutely stunned. This is a very safe neighbourhood, very decent area of Tracy,” neighbour Dave Roychowdhury said.

“Nothing has ever happened like this here,” he said.

Tracy Mayor Robert Rickman in a statement said, “We take pride in our safe, close-knit community. The loss of one of our own to violence has shaken us to our core and is felt by the entire community.
